Law and the Politics of Memory: Confronting the Past examines law’s role as a tool of memory politics in the efforts of contemporary societies to work through the traumas of their past. Using the examples of French colonialism and Vichy, as well as addressing the politics of memory surrounding the Holocaust, communism and colonialism, this book provides a critical exploration of law’s role in ‘belated’ transitional justice contexts. The book examines how and why law has become so central in processes in which the past is constituted as a series of injustices that need to be rectified and can allegedly be repaired. As such, it explores different legal modalities in processes of working through the past; addressing the implications of regulating history and memory through legal categories and legislative acts, whilst exploring how trials, restitution cases, and memory laws manage to fulfil such varied expectations as clarifying truth, rendering homage to memory and reconciling societies. In contemporary life, the marketplace has emerged as an important arena for the practice of politics. Concerns about personal and family well-being as well as ethical or political assessment of favorable and unfavorable business and government practices become part and parcel of the marketplace of politics. This volume describes this phenomenon as political consumerism, reflecting an understanding of politics as a product embedded in a complex social and normative context. Politics, Products, and Markets is the first general study of political consumerism. It asks fundamental questions, including what is new and what is old about the phenomenon. The authors discuss the mediating role of political consumerism in the problematic relationship between markets and morality. They explore whether institutional arrangements have been developed to permit consumers and producers to assume ethical responsibility for their choices and behavior. They ask why political consumerism is presently on the rise. And they investigate the relationship between globalization and political consumerism. Since the appearance of Hayden White’s seminal work Metahistory in 1973, constructivist thought has been a key force within theory of history and has at times even provided inspiration for historians more generally. Despite the radical theoretical shift marked by constructivism and elaborated in detail by its proponents, confusion regarding many of its practical and ethical consequences persists, however, and its position on truth and meaning is routinely misconstrued. To remedy this situation, The Work of History seeks to mediate between constructivist theory and history practitioners’ intuitions about the nature of their work, especially as these relate to the so-called fact–fiction debate and to the literary challenges involved in the production of historical accounts.
