Reclaiming Collective Rights

In Peru, since 1974, more than 1,200 communities have been titled in the Amazon for over 12 million hectares, representing about 20% of the country's national forest area. This working paper analyzes policy and regulatory changes that have influenced how indigenous peoples access, use and manage forest and land resources in the Peruvian Amazon during the last fifty years. It reviews the main motivations behind changes, the institutional structures defined by law and the outcomes of these changes in practice. The paper discusses political priorities related to land and forest tenure, social actors involved in reform debates and the mechanisms used for recognizing indigenous rights claims. The paper argues that there has not been a single reform process in Peru; instead multiple reforms have shaped forest tenure rights, contributing to both progress and setbacks for indigenous people and communities. This working paper is part of a global comparative research initiative that is analyzing reform processes that recognize collective tenure rights to forests and land in six countries in highly forested regions.

Regional governments have a central role in the formalization process as they are in the most direct contact with native communities. Nonetheless, incomplete decentralization has led to inadequate budget and trained personnel. The Ministry of Economy and Finance should incorporate allocations for community titling procedures in the national budget. There are incongruities between the expectations of native communities and the scope of the regulations that formalize collective rights – especially those related to rights to resources, the implications of usufruct contracts and the differences in rights granted over lands classified as forest versus agriculture. The results show that investing in coordination and collaboration mechanisms has the potential to increase the effectiveness of implementation. This requires assigning budgets and promoting measures supporting information exchange and formal agreements to implement joint actions.

Reclaiming Participatory Governance offers empirical and theoretical perspectives on how the relationship between social movements and state institutions is emerging and developing through new modes of participatory governance. One of the most interesting political developments of the past decade has been the adoption by social movements of strategies seeking to change political institutions through participatory governance. These strategies have flourished in a variety of contexts, from anti-austerity and pro-social justice protests in Spain, to movements demanding climate transition and race equality in the UK and the USA, to constitutional reforms in Belgium and Iceland. The chief ambition and challenge of these new forms of participatory governance is to institutionalise the prefigurative politics and social justice values that inspired them in the first place, by mobilising the bureaucracy to respond to their claims for reforms and rights. The authors of this volume assess how participatory governance is being transformed and explore the impact of such changes, providing timely critical reflections on: the constraints imposed by cultural, economic and political power relations on these new empowered participatory spaces; the potential of this new "wave" of participatory democracy to reimagine the relationship between citizens and traditional institutions towards more radical democratic renewal; where and how these new democratisation efforts sit within the representative state; and how tensions between the different demands of lay citizens, organised civil society and public officials are being managed. Democracy is in shambles economically and politically. The recent economic meltdown in Europe and the U.S. has substituted democratic deliberation with technocratic decisions. In Athens, Madrid, Lisbon, New York, Pittsburgh or Istanbul, protesters have denounced the incapacity and unwillingness of elected officials to heed to their voices. While the diagnosis of our political-economic illness has been established, remedies are hard to come. What can we do to restore our broken democracy? Which modes of political participation are likely to have an impact? And what are the loci of political innovation in the wake of the crisis? It is with these questions that Reclaiming Democracy engages. We argue that the managerial approach to solving the crisis violates ‘a right to politics’, that is, a right that our collective life be guided by meaningful politics: by discussion of and decision among genuinely alternative principles and policies. The contributors to this volume are united in their commitment to explore how and where this right can be affirmed in a way that resuscitates democracy in the wake of the crisis. Mixing theoretical reflection and empirical analysis the book offers fresh insights into democracy’s current conundrum and makes concrete proposals about how ‘the right to politics’ can be protected.
