Religious Minorities In Pluralist Societies

The accommodation of religious diversity in contemporary pluralist societies is undoubtedly amongst the most salient issues on today’s political agenda, not least due to the challenges posed by migration. A subject of considerable debate is how to reconcile the demands of religious and cultural diversity alongside political unity, that is, how to create a political community that is cohesive and stable and satisfies the legitimate aspirations of minorities. This volume provides a critical analysis of the institutional accommodations and legal frameworks conceived by and/or for historical religious groups and assesses their potential and shortcomings in providing for an integrated society based on human- and minority rights protection.

Law and Religious Pluralism in Canada seeks to elucidate the complex and often uneasy relationship between law and religion in democracies committed both to equal citizenship and religious pluralism. Leading socio-legal scholars consider the role of religious values in public decision making, government support for religious practices, and the restriction and accommodation by government of minority religious practices. They examine such current issues as the legal recognition of sharia arbitration, the re-definition of civil marriage, and the accommodation of religious practice in the public sphere.

With the theory of secularization increasingly contested as a plausible development at a global scale, this book focuses on the changing significance of the religious element within a context of complex diversity. This concept reflects the rationale behind the deep transformations that have taken place in the dynamics of social change, giving way to a recombination of social, political and cultural cleavages that overlap and compete for legitimacy at a national and supranational level. Far from disappearing with modernization, new forms of religious diversity have emerged that continue to demand specific policies from the state, putting pressure on the established practices of religious governance while creating a series of normative dilemmas. European societies have been a testing ground for many of these changes, but for decades Canada has been viewed as a pioneering country in the management of diversity, thus offering some interesting similarities and contrasts with the former. Accordingly, the book deals with the diverging routes that political secularization has followed in Europe and Canada, the patterns of religious governance that can be recognized in each region, and the practices for accommodating the demands of religious minorities concerning their legal regulation, the management of public institutions, and the provision of social services.

This volume illustrates both theoretically and empirically the differences between religious diversity and religious pluralism. It highlights how the factual situation of cultural and religious diversity may lead to individual, social and political choices of organized and recognized pluralism. In the process, both individual and collective identities are redefined, incessantly moving along the continuum that ranges from exclusion to inclusion. The book starts by first detailing general issues related to religious pluralism. It makes the case for keeping the empirical, the normative, the regulatory and the interactive dimensions of religious pluralism analytically distinct while recognizing that, in practice, they often overlap. It also underlines the importance of seeking connections between religious pluralism and other pluralisms. Next, the book explores how religious diversity can operate to contribute to legal pluralism and examines the different types of church-state relations: eradication, monopoly, oligopoly and pluralism. The second half of the book features case studies that provide a more specific look at the general issues, from ways to map and assess the religious diversity of a whole country to a comparison between Belgian-French views of religious and philosophical diversity, from religious pluralism in Italy to the shifting approach to ethnic and religious diversity in America, and from a sociological and historical perspective of religious plurality in Japan to an exploration of Brazilian religions, old and new. The transition from religious diversity to religious pluralism is one of the most important challenges that will reshape the role of religion in contemporary society. The subject of this book is ritual behaviour, in particular of groups with a distinctive religious, ethnic or other identity which use rituals to pursue strategic ends ad intra and ad extra. Five essays offer theoretical perspectives on ritual in plural and pluralist societies, on similarity and demarcation, on the negative case of the Australian Aboriginals, on Brazilian religious pluralism, and on Ghanaian churches in the Netherlands. Three essays describe the ritualization of the encounter, or confrontation, between religions in India (between Buddhists and Hindus, and between Hindus and Muslims), and in Yemen between Muslims and Jews. Four essays study the responses to internal religious plurality, in early Israel, on Java, in Indonesia, and in Spain and North Africa. One essay explores responses to external religious plurality. In the epilogue, the social nature of pluralism and identity is highlighted.
