Securing Outer Space

This edited volume analyses a number of controversial policies and strategies relating to Space activities, and to place these in a broader theoretical perspective. The book reveals the relationship between activities in Outer Space and terrestrial international relations.

Space Security involves the use of space (in particular communication, navigation, earth observation, and electronic intelligence satellites) for military and security purposes on earth and also the maintenance of space (in particular the earth orbits) as safe and secure areas for conducting peaceful activities. The two aspects can be summarized as "space for security on earth" and “the safeguarding of space for peaceful endeavors.” The Handbook will provide a sophisticated, cutting-edge resource on the space security policy portfolio and the associated assets, assisting fellow members of the global space community and other interested policy-making and academic audiences in keeping abreast of the current and future directions of this vital dimension of international space policy. The debate on coordinated space security measures, including relevant 'Transparency and Confidence-Building Measures,' remains at a relatively early stage of development. The book offers a comprehensive description of the various components of space security and how these challenges are being addressed today. It will also provide a number of recommendations concerning how best to advance this space policy area, given the often competing objectives of the world's major space-faring nations. The critical role to be played by the United States and Europe as an intermediary and "middle diplomat" in promoting sustainable norms of behavior for space will likewise be highlighted. In providing a global and coherent analytical approach to space security today, the Handbook focuses on four areas that together define the entire space security area: policies, technologies, applications, and programs. This structure will assure the overall view of the subject from its political to its technical aspects. Internationally recognized experts in each of the above fields contribute, with their analytical synthesis assured by the section editors.

"Historically, strategic restraint was the dominant approach among nations active in outer space, all of whom understood that continued access to and use of space required holding back on threats or activities which might jeopardize the status quo of peace in space. However, recently there has been a discernible shift in international rhetoric towards a more offensive approach to defense in space. The U.S. move towards establishing a "Space Force" has been echoed by similar announcements in France and Japan. India launched an anti-satellite weapon test and announced proudly that it thereby joined the elite group of China, Russia and the U.S., who have all demonstrated this capability in the past. And as technologies in space advance, along with our terrestrial dependence on space-based systems for our peaceful civilian lives and for support of terrestrial warfare, the political stability of this vulnerable environment comes under threat. These factors, combined with a lack of transparency about actual capabilities and intentions on the part of all major players in space, creates a cyclical escalation which has led some commentators to describe this as a return to a Cold War-type arms race, and to the foreseeability of a space-based conflict. Due to many unique characteristics of the space domain, an armed conflict in space would be catastrophic for all players, including neutral States, commercial actors, and international civil society. Due to the specificity of the space domain, specialized expertise must be provided to decision-makers, and interdisciplinary opinions must be sought from a multitude of stakeholders. To that end, this volume provides a wide spectrum of perspectives from experts who have engaged together at a conference hosted by the Center for Ethics in the Rule of Law to discuss these issues. The past five decades have witnessed often fierce international rivalry in space, but also surprising military restraint. Now, with an increasing number of countries capable of harming U.S. space assets, experts and officials have renewed a long-standing debate over the best route to space security. Some argue that space defenses will be needed to protect critical military and civilian satellites. Others argue that space should be a "sanctuary" from deployed weapons and military conflict, particularly given the worsening threat posed by orbital space debris. Moltz puts this debate into historical context by explaining the main trends in military space developments since Sputnik, their underlying causes, and the factors that are likely to influence their future course. This open access book explores the legal aspects of cybersecurity in Poland. The authors are not limited to the framework created by the NCSA (National Cybersecurity System Act - this act was the first attempt to create a legal regulation of cybersecurity and, in addition, has implemented the provisions of the NIS Directive) but may discuss a number of other issues. The book presents international and EU regulations in the field of cybersecurity and issues pertinent to combating cybercrime and cyberterrorism. Moreover, regulations concerning cybercrime in a few select European countries are presented in addition to the problem of collision of state actions in ensuring cybersecurity and human rights. The advantages of the book include a comprehensive and synthetic approach to the issues related to the cybersecurity system of the Republic of Poland, a research perspective that takes as the basic level of analysis issues related to the security of the state and citizens, and the analysis of additional issues related to cybersecurity, such as cybercrime, cyberterrorism, and the problem of collision between states ensuring security cybernetics and human rights. The book targets a wide range of readers, especially scientists and researchers, members of legislative bodies, practitioners (especially judges, prosecutors, lawyers, law enforcement officials), experts in the field of IT security, and officials of public authorities. Most authors are scholars and researchers at the War Studies University in Warsaw. Some of them work at the Academic Centre for Cybersecurity Policy - a thinktank created by the Ministry of National Defence of the Republic of Poland. .

This will be the first book to attempt to take a 'holistic' approach to security in the Commons (outer space, the atmosphere, the oceans, cyberspace, etc) in that it examines in detail each domain of the commons, identifying and assessing the current and future threats to free international access to the domain.

Man has reached the final frontier and breached it too. Historically, the advent into outer space was a spin-off of military adventurism, yet it has laid bare myriad opportunities for scientific exploration, peaceful uses and excavation of natural resources. Each aspect offers great potential for the benefit of mankind and improvement in the quality of life. Till lately, most of the space activities were carried out within the public domain by military personnel. This trend has abated and private enterprise has entered the arena in a big way in telecommunications, broadcasting, remote-sensing and space travel. Many other fields, like gravity-free manufacturing, production of vaccines in a sterile environment, super-conductors in extreme cold ambience, and space hospitality are waiting in the wings to be exploited. The possibilities seem endless. The corpus of Space Law, so far, in the form of Conventions, Treaties and Agreements has come about more out of necessity and urgency consequent to the circumstances or to remedy contingent situations. It has not evolved systematically with experience or over relatively long periods of time. For example, the Outer Space Treaty, however laudable, is a medley of compromises, with advertent loopholes. The Moon Treaty has found little acceptance and fewer ratifications. The Rescue Agreement was an exigent measure. The UN guidelines on remote-sensing and prevention of debris are not mandatory. Commercialisation of outer space by private corporations has already begun and is galloping. But the existing law hardly provides an impetus to this trend - in fact, it is obstructive. Space Law has lagged behind technology and needs to keep in step to regulate activities in outer space for peace and commerce. This book addresses some of these problems and issues viz. Space Law, commercial aspects, military issues of weaponisation and defence strategies, and other space applications. Each chapter aims to highlight some lacunae and shortcomings while, at the same time, offering some viable suggestions. The book is, thus, thought-provoking and timely.
