In the West, "sharia" often calls to mind antiquated laws founded upon gender discrimination and barbaric punishments. In the East, for some it means the ideal standards by which Muslims strive to live; for others, it is the greatest obstacle to modernization of their societies. These clashing views sometimes lead to violence. Clarification of the term has therefore become an urgent necessity. Sharia is all of these things and much more. It is the legal system of Islam, a series of guidelines and prohibitions. But it is also a concept invested with a whole range of meanings, from the virtuous attributes of an "'ideal"' society, to the confinement of particular elements to otherness and adversity. Moving through history, society and Islamic thought to explore the sources of sharia law, Baudouin Dupret gets to the heart of its uses and abuses in the twentieth and twenty-first centuries. This short, accessible book provides an invaluable guide for those seeking to understand a matter more complex and pressing today than ever before.

Sharia is by now a term that most Americans and Europeans recognize, though few really understand what it means. Often portrayed as a medieval system used by religious zealots to oppress women and deny human rights, conservative politicians, media commentators, and hardline televangelistsstoke fear by promoting the idea that Muslims want to impose a repressive Sharia rule in America and Europe. Despite the breadth of this propaganda, a majority of Muslims - men and women - support Sharia as a source of law. In fact, for many centuries Sharia has functioned for Muslims as a positivesource of guidance, providing a moral compass for individuals and society. This critical new book by John L. Esposito and Natana Delong-Bas aims to serve as a guide for what everybody needs to know in the conversation about Sharia, responding to misunderstandings and distortions, and offeringanswers to questions about the origin, nature, and content of Sharia.

A direct counterpoint to fear mongering headlines about shariah law—a Muslim American legal expert tells the real story, eliminating stereotypes and assumptions with compassion, irony, and humor Through scare tactics and deliberate misinformation campaigns, anti-Muslim propagandists insist wrongly that shariah is a draconian and oppressive Islamic law that all Muslims must abide by. They circulate horror stories, encouraging Americans to fear the “takeover of shariah” law in America and even mounting “anti-shariah protests” . . . . with zero evidence that shariah has taken over any part of our country. (That’s because it hasn’t.) It would be almost funny if it weren’t so terrifyingly wrong—as puzzling as if Americans suddenly began protesting the Martian occupation of Earth. Demystifying Shariah explains that shariah is not one set of punitive rules or even law the way we think of law—rigid and enforceable—but religious rules and recommendations that provide Muslims with guidance in various aspects of life. Sumbul Ali-Karamali draws on scholarship and her degree in Islamic law to explain shariah in an accessible, engaging narrative style—its various meanings, how it developed, and how the shariah-based legal system operated for over a thousand years. She explains what shariah means not only in the abstract but in the daily lives of Muslims. She discusses modern calls for shariah, what they mean, and whether shariah is the law of the land anywhere in the world. She also describes the key lies and misunderstandings about shariah circulating in our public discourse, and why so many of them are nonsensical. This engaging guide is intended to introduce you to the basic principles, goals, and general development of shariah and to answer questions like: How do Muslims engage with shariah? What does shariah have to do with our Constitution? What does shariah have to do with the way the world looks like today? And why do we all—Muslims or not—need to care?

The application of Shariah compliance in business transactions continues to increase. The Asian financial crisis of 1997, global financial crisis of 2007-2008, Enron scandal and other reported ills besieging conventional business transactions have led to advocates of Shariah-compliant business transactions promoting the latter as a credible alternative. However, unlike the banking, commerce and financial sectors, the uptake by the construction sector was sluggish due to limited understanding of Shariah among the practitioners and policymakers compounded by the lack of research and publications on its application for the construction sector. This book is intended for students, researchers, practitioners and policymakers of the construction industry as well as the related upstream and downstream activities. It offers basic theories, challenges current practices, and proposes innovative ideas on Shariah compliance and its application for the construction industry.Related Link(s)

This research does not represent the conventional notion about Shari'ah and its implementation in politics or state policy levels. It rather advocates the aspects of ultimate goal in a specific and unique perspectives which focuses simply the relationship to God and the human in the individual level. The concept of the legal or Jurisprudential aspects are not represented in this research due to following reasons. (1)The society is built on individuals, Islam focuses on individual first, then it expands gradually to the society, as Quran states "save yourself and your people, (family friends) from fire" (Quran 66:6); the first and foremost thing in the concept of Shariah is an individual to build the bond with the God through worldly life, that is Taqwa, that is Ihsan, that is shariah. (2)Even though undoubtedly societal and jurisprudential aspects are one of the aspects of Shariah, however that is totally depended on several crucial conditions and variations by Usul al Fiqh. Such as Khas, 'Am, (exclusive and public); Mustarak, Muawwal, (Communal and Constructed); Haqiqat, Majaz, (Factual and Metaphoric); Sarih, Kinaya (Candid and Metonymy) etc. Understanding the context and circumstances are more important than jumping on to the text that may lead a learner to misinterpretation. This research addresses to the ultimate goal of Shariah in the aspects of relationship to God and human. This research incorporates Islam and Shariah in the consistent connotation, which advocates that the ultimate advocacy of Islam is to reach the God and serve the universe. This research provides Quranic verses and prophetic tradition in support of its advocacy that the core objective of Shari'ah is to build relationship to the God and to serve the humanity; improving the spirit of individuals and society, and this objective can be achieved through wisdom and understanding, justice and efficient performances. This also may achieved by great contributions for the benefit and welfare of humanity in this world and in the hereafter. And these welfare and benefit can be possible only through justice, mercy, understanding (Fiqh). We advocate that the shariah is the way of life of a Muslim, who has the ultimate goal to reach the love of God, and excellence or best success in this life and in the hereafter. The notion of success in the world and hereafter is based on the Quranic verse which prays "Our Lord! grant us good in this world and good in the hereafter". (Quran 2:201)However, this research is absolutely based on the Quranic verses and prophetic Hadiths related to some fundamental Islamic terminologies such as Fiqh, Taqwa, 'Adl, Ihsan. This study is mainly divided into twelve chapters in three main parts. Part One is the Introduction which includes one chapter of definitions. Part Two is the Objective of Shariah which advocates the Objective of Shariah is to build Love of God and to serve the creature, Part Two includes 7 chapter which include Concept of God, Human Relations to God, Creation of the Universe, Creation of Mankind, Justice is the Key Component, Justice with accountability, Excellence a major component. Finally, Part Three includes 4 chapters; all of which describe the historic advocacy for public interest as a part of Shariah. The core concept of the discussion of Part One introduction is to advocate that the term Shariah cannot be understood or used without understanding the context. It is totally wrong use the Shariah from just textual perspective. The final part of Historical aspect discusses that a few main terminologies have been used as part of Shariah which advocate absolute human benefit. Final chapter discusses the history of advocacy about human benefit as it is a forgotten dimension on the historical dimension of the objectives of Shariah. This research tries to prove that the Shariah cannot be understood without Fiqh (understanding) and usul al Fiqh (fundamental of Fiqh).
