This book brings together leading international criminologist to examine the link between the fruits of criminological research and the development of criminal justice policy. This volume includes comparative discussions of the United States, Germany, Australia, England and Wales. It is divided into four parts: Part 1 discusses the theoretical issues surrounding the relationship between public policy and the discipline of criminology; Part 2 consists of three essays exploring historical aspects of that relationship. Part 3 then examines three distinct areas of penal policy: sentencing, policing and parole; Part 4 is devoted to international comparisons and considers the factors that distinguish research projects that influence criminal justice policy from those that appear not have any influence.

This book is the first examination of the history of prison policy in Ireland. Despite sharing a legal and penal heritage with the United Kingdom, Ireland’s prison policy has taken a different path. This book examines how penal-welfarism was experienced in Ireland, shedding further light on the nature of this concept as developed by David Garland. While the book has an Irish focus, it has a theoretical resonance far beyond Ireland. This book investigates and describes prison policy in Ireland since the foundation of the state in 1922, analyzes and assesses the factors influencing policy during this period and explores and examines the links between prison policy and the wider social, economic, political and cultural development of the Irish state. It also explores how Irish prison policy has come to take on its particular character, with comparatively low prison numbers, significant reliance on short sentences and a policy-making climate in which long periods of neglect are interspersed with bursts of political activity all prominent features. Drawing on the emerging scholarship of policy analysis, the book argues that it is only through close attention to the way in which policy is formed that we will fully understand the nature of prison policy. In addition, the book examines the effect of political imprisonment in the Republic of Ireland, which, until now, has remained relatively unexplored. This book will be of special interest to students of criminology within Ireland, but also of relevance to students of comparative criminal justice, criminology and criminal justice policy making in the UK and beyond.

Advancing Criminology and Criminal Justice Policy is a definitive sourcebook that is comprised of contributions from some of the most recognized experts in criminology and criminal justice policy. The book is essential reading for students taking upper level courses and seminars on crime, public policy and crime prevention, as well as for policy makers within the criminal justice sphere. There has been a growing recognition of the importance of evidence-based criminal justice policies from criminologists, policymakers, and practitioners. Yet, despite governmental and professional association efforts to promote the role of criminological research in criminal justice policy, political ideologies, fear, and the media heavily influence criminal justice policies and practices. Bridging the gap between research and policy, this book provides the best-available research evidence, identifies strategies for informing policy and offers direct policy recommendations for a number of pressing contemporary issues in criminal justice, including: Delinquency, intervention programs and community crime prevention, Problem-oriented policing and the science of hot-spot policing, Sentencing and drug courts, Community corrections, incarceration and rehabilitation, Mental illness, gender, aging and indigenous communities.

Twenty-five leading contemporary theorists of criminal law tackle a range of foundational issues about the proper aims and structure of the criminal law in a liberal democracy. The challenges facing criminal law are many. There are crises of over-criminalization and over-imprisonment; penal policy has become so politicized that it is difficult to find any clear consensus on what aims the criminal law can properly serve; governments seeking to protect their citizens in the face of a range of perceived threats have pushed the outer limits of criminal law and blurred its boundaries. To think clearly about the future of criminal law, and its role in a liberal society, foundational questions about its proper scope, structure, and operations must be re-examined. What kinds of conduct should be criminalized? What are the principles of criminal responsibility? How should offences and defences be defined? The criminal process and the criminal trial need to be studied closely, and the purposes and modes of punishment should be scrutinized. Such a re-examination must draw on the resources of various disciplines-notably law, political and moral philosophy, criminology and history; it must examine both the inner logic of criminal law and its place in a larger legal and political structure; it must attend to the growing field of international criminal law, it must consider how the criminal law can respond to the challenges of a changing world. Topics covered in this volume include the question of criminalization and the proper scope of the criminal law; the grounds of criminal responsibility; the ways in which offences and defences should be defined; the criminal process and its values; criminal punishment; the relationship between international criminal law and domestic criminal law. Together, the essays provide a picture of the exciting state of criminal law theory today, and the basis for further research and debate in the coming years.
