The Europeanisation Of Parliamentary Democracy

This groundbreaking new study shows how the process of creating an ever closer European Union affects not only the policy-making, but also the politics and polity of the Member States. Empirical studies on the domestic impact of Europe identified different forms of Europeanization due to alternative mechanisms of internalising the new norms and rules. Although many studies have since focused on the question of how, to what degree, in what direction, at what pace, and at what point of time "Europe matters", the Europeanization of one particular structural determinant of the Member States, namely the system of parliamentary democracy, is still under-researched. This is all the more astonishing as democracy in the EU depends to a large extent on the democratic legitimacy of procedures at the national level. This volume addresses the key issue of the Europeanisation of parliamentary systems and thus contributes to the ongoing debate on the parliamentary dimension of the European Union. It brings together theoretical concepts as well as cross-national empirical research on the Europeanization of the member states’ parliamentary systems, focussing on different elements such as structures, procedures and decision-making processes as well as on the question how parliamentarians as actors react to these changes and actively shape this Europeanization. This book analyses nearly 100 original interviews with Members of the European Parliament from across the European Union who were active between 1979 and 2019. These interviews, preserved in the Historical Archives of the European Union at the European University Institute, capture the memories of the MEPs about their own roles and their assessment of what the parliament achieved in developing a European parliamentary democracy in the forty years following the first direct elections. This book offers a new approach to the study of European democracy showing how this has developed through key episodes in the long history of the process: precursors in the Low Countries; the founding of British parliamentary then American federal democracy; post-revolutionary France; post-war Germany; the European Parliament. It examines the significance of each episode in the development of national or federal democracy and concludes with a positive assessment of the prospects of liberal democracy. There seems to be a growing tendency, as prominently shown by the fall of the Santer Commission in 1999 and expressed more recently in the Constitutional Treaty, to construe the relationship between the Commission and the European Parliament as a parliamentary system. In a parliamentary system the government gives account of its action to Parliament and, where appropriate, suffers the consequences, takes the blame, or puts matters right if errors have been made. The government remains in office only as long as it has the confidence of the majority in Parliament and until Parliament votes a motion of censure or the government resigns. This study further develops a European concept of political accountability. The basic assumption of the project is that such a concept must be firmly rooted in the longstanding constitutional traditions of the Member States. From this perspective, it is relevant to try to identify what political accountability precisely means in the various Member States. This proves to be far from evident. The concept of political accountability substantially differs from country to country. For example, political accountability in Italy and France primarily seems to focus on resignation of ministers whereas political accountability in the United Kingdom or the Netherlands aims at the process of giving account. In order to analyze the various approaches and to try to identify common principles, this book brings together 12 distinguished constitutional lawyers and political scientists who have analyzed the concept of political accountability from their national perspectives. The book also includes a final comparative chapter that examines the parallels and the differences between the national systems and explores to what extent common ground can be found in Europe.

Why have the national governments of EU member states successively endowed the European Parliament with supervisory, budgetary, and legislative powers over the past fifty years? Building Europe's Parliament sheds new light on this pivotal issue, and provides a major contribution to the study of the European Parliament. Rittberger develops a theory of delegation to representative institutions in international politics which combines elements of democratic theory and different strands of institutionalist theory. To test the plausibility of his theory, Rittberger draws on extensive archival material and offers theory-guided, in-depth case studies of three landmark decisions in the history of the European Parliament: the creation of the Common Assembly of the ECSC in 1951 and the concomitant acquisition of supervisory powers vis-à-vis the quasi-executive High Authority; the delegation of budgetary powers following the signing of the Treaty of Luxembourg in 1970; and the delegation of legislative powers resulting from the adoption of the Single European Act signed in 1986. This is followed by the charting of more recent key developments, culminating in the adoption of the Constitutional Treaty in 2004. The book provides a welcome addition to the literature on institutional design by reflecting on the conditions under which governments opt for the creation and empowerment of parliamentary institutions in international politics. It also makes a valuable contribution to the application of democratic theory to the study of the European Union by demonstrating that political elites shared the view that the new supranational polity which emerged from the debris of World War II suffered from 'democratic deficit' since its inception, thus disproving the claim that the lamented 'democratic deficit' is a recent phenomenon.

This edited collection explores the perceptions and memories of parliamentarianism across Europe, examining the complex ideal of parliament since 1800. Parliament has become the key institution in modern democracy, and the chapters present the evolution of the ideal of parliamentary representation and government, and discuss the reception and value of parliament as an institution. It is considered both as a guiding concept, a Leitidee, as well as an ideal, an Idealtypus. The volume is split into three sections. The establishment of parliament in the nineteenth century and the transfer of parliamentary ideals, models and practices are described in the first section, based on the British and French models. The second part explores how the high expectations of parliamentary democracy in newly-established states after the First World War gradually started to subside into dissatisfaction. Finally, the last section attests to its resilience after the Second World War, demonstrating the strength of the ideal of parliament and its power to incorporate criticism. Examining the history of parliament through concepts and ideals, this book traces a transnational, European exchange of models, routines and discourse.

In this book, Katarzyna Granat analyses and evaluates Europe's experience with the Early Warning System (EWS) which allows national parliaments to review draft legislative acts of the European Union for their compatibility with the subsidiarity principle. The EWS was introduced in response to the perceived 'democratic deficit' of the EU and its 'creeping' competences, and represented one of the landmark reforms of the Lisbon Treaty. The purpose of this book is to present and critically analyse the functioning of the new mechanism of subsidiarity review and the role that national parliaments have played within this system.
