This working document offers a conceptual framework for understanding the processes underpinning the external dimension of EU Justice and Home Affairs (ED-JHA). Practically, it defines how the export of JHA principles and norms inform the geopolitical ambitions of the EU, i.e. the use of space for political purposes, or the control and management of people, objects and movement. The author begins by investigating how the ENP reconfigures the ED-JHA, and then goes on to discuss various conceptual stances on governance, specifically institutionalism, constructivism, and policy instruments. To conclude he traces the evolution of this external dimension, emphasising, whenever possible, its continuities and bifurcations. Overall, the aim is to ascertain the extent to which conceptual designs clarify or advance our knowledge of the contents and rationales of the ED-JHA.

This book provides an analysis of the European Neighbourhood Policy by focusing on the impact of norms of justice and home affairs on EU external relations. Drawing on the literature of 'new governance' it designs a framework for analysis which clarifies the contents, tools and processes of the external dimension of EU justice and home affairs.

This book proposes to cast some theoretical and empirical light upon the external dimension of Justice and Home Affairs (JHA) which has become a priority in the European Union (EU)’s external relations. Counter-terrorism, visa policy, drug trafficking, organized crime or border controls have indeed become daily business in EU’s relations with the rest of the world. The external dimension of JHA is a persistent policy objective of the EU and its member states, as the 1999 Tampere summit conclusions, the 2000 Coreper report, the 2005 Strategy for the External Dimension of JHA, and the integration of JHA chapters under the European Neighbourhood Policy testify. With an interdisciplinary ambition in mind, this book reflects an attempt to draw together theoretical and empirical insights on the external dimension written by academic scholars that take an interest in questions of JHA and European Foreign Policy (EFP). It does so from an issue-oriented perspective (civilian crisis management, the European Neighbourhood Policy, counter-terrorism policy, visa policy, passenger name record) but also from a geographical perspective with in-depth analysis of the situation in the Western Balkans, Georgia, transatlantic relations and of the Mediterranean neighbourhood. This book was published as a special issue of the Journal of European Integration.

During the last decade the rapid growth of justice and home affairs as an internal policy making domain of the European Union has led to the Union emerging as an increasingly important international actor in this field. This book covers the institutional and legal framework of the external dimension of EU justice and home affairs; issues of policy interaction as well as specific challenges; policy responses and results in the fields of migration policy; judicial cooperation; counter-terrorism; and cooperation with major international partners. This book examines the role of agencies and agency-like bodies in the EU’s Area of Freedom, Security and Justice (AFSJ).When the Maastricht Treaty entered into force on 1 November 1993, the institutional landscape of the so-called ‘Third Pillar’ looked significantly different than it does now. Aside from Europol, which existed only on paper at that time, the European agencies examined in this book were mere ideas in the heads of federalist dreamers or were not even contemplated. Eventually, Europol slowly emerged from its embryonic European Drugs Unit and became operational in 1999. Around the same time, the European Union (EU) unveiled plans in its Tampere Programme for a more extensive legal and institutional infrastructure for internal security policies. Since then, as evidenced by the chapters presented in this book, numerous policy developments have taken place. Indeed, the agencies now operating in the EU’s Area of Freedom, Security and Justice (AFSJ) are remarkable in the burgeoning scope of their activities, as well as their gradually increasing autonomy vis-à-vis the EU member states and the institutions that brought them to life. This book was published as a special issue of Perspectives on European Politics and Society.

Justice and Home Affairs is one of the fastest expanding areas of research in European Studies. The European response to security concerns such as terrorism, organised crime networks, and drug trafficking as well as to the challenge of managing migration flows are salient topics of interest to an increasing number of scholars of all disciplines, the media and general public. In recent decades, the external action of the European Union (EU) has been undergoing considerable change. An expansion of the EU’s external policy portfolio can be observed in many areas as previous policies for internal purposes – such as competition, energy, the environment, justice and home affairs or monetary governance but also gender, science, culture or higher education – have developed external dimensions. This book addresses the EU’s potential to become a more joined-up global actor in its external engagement. It uses a single and innovative analytical framework to examine three clusters of policies: EU internal sectoral and cross-cutting policies with long-standing external engagement, those which have been undergoing considerable change, and originally internal policies whose external dimensions are comparatively more recent. It identifies key explanatory factors for the emergence of (certain forms of) EU external engagement and identifies patterns of the evolving relations between EU internal and external sectoral policies. As such, the book examines and assesses exciting new empirical and theoretical research avenues into European integration studies and offers insights into the extent to which the EU may be considered a more joined-up global actor developing sectoral diplomacies. This text will be of key interest to scholars and students as well as practitioners in the fields of European Union politics, European Union foreign policy, European Politics, diplomacy studies, and more broadly law and international relations.

The European Union is rapidly creating a European space in which citizens can live in Justice, Liberty and Security. This bold push forward in the European integration process touches on three highly sensitive societal subjects: immigration and asylum, civil law, and criminal law. At the same time, work in this area necessarily has an external dimension: we only need to think about asylum and the post September 11 fight against terrorism. Within the European Union, this dynamic development of the external side of justice and home affairs raises challenging issues: friction over the division of competences between the Union and its Member States and between EU institutions; cross-pillar coordination issues; legal and political tensions due to "variable geometry" with numerous "opt-ins" and "opt-outs".
