The New Asylum And Transit Countries In Europe During And In The Aftermath Of The 2015 2016 Crisis

Understanding the realities of protection in a Europe that had failed to manage the crisis in asylum that unfolded in 2015 and 2016 requires a comprehension of how law shapes and distorts refugee protection practices in frontline states. In this collection Vladislava Stoyanova and Eleni Karageorgiou provide an essential cartography of the state of asylum during the crisis. The volume captures four dynamics: the absorption of EU norms in Central and South Eastern Europe; the reaction in this region to the massive movement of asylum seekers in 2015 and 2016; the initiation of normative developments in the area of asylum during and beyond the crisis by the countries in this region; and the question of solidarity.

The Convention Relating to the Status of Refugees adopted on 28 July 1951 in Geneva continues to provide the most comprehensive codification of the rights of refugees yet attempted. Consolidating previous international instruments relating to refugees, the 1951 Convention with its 1967 Protocol marks a cornerstone in the development of international refugee law. At present, there are 149 States Parties to one or both of these instruments, expressing a worldwide consensus on the definition of the term refugee and the fundamental rights to be granted to refugees. These facts demonstrate and underline the extraordinary significance of these instruments as the indispensable legal basis of international refugee law. This Commentary provides for a systematic and comprehensive analysis of the 1951 Convention and the 1967 Protocol on an article-by-article basis, exposing the interrelationship between the different articles and discussing the latest developments in international refugee law. In addition, several thematic contributions analyse questions of international refugee law which are of general significance, such as regional developments, the interrelationship between refugee law and general human rights law, as well as the relationship between refugee law and the law of the sea.

Academic discussion of climate‐related human mobility has understandably focused on the places where people are especially vulnerable to climate‐related harm: the Global South. Yet, the unique biophysical, legal and socio‐political characteristics of the Nordic region, as well as its roles as both ‘home’ and ‘host’ to climate‐related mobilities, justify its independent attention. Filling this lacuna, this collection is the first to address climate‐related human mobility in the Nordic region. It is a timely and much needed collection, which brings together leading and emerging voices from both academia and practice in a single volume, spanning policy and geographical breadth. Its chapters cover both regional approaches to the global phenomenon of climate mobility, such as the traditional role of the Nordic states as norm entrepreneurs and their representation in multilateral fora, and on‐the‐ground climate impacts unique to this region and their localised responses. Case studies include judicial decision‐making as it relates to climate‐related migration, insights into the local communication of climate risk, changes to Nordic development and climate policy, as well as climate‐related mobilities of Nordic Indigenous Peoples. This contributed volume examines the trend whereby the EU resorts ever more often to informal arrangements and deals with third countries in an effort to curb and manage migration flows towards the EU and facilitate the return of irregular migrants to their countries of origin or transit. The perceived success of the EU-Turkey deal provided a strong impetus for the continuation of this trend. The contributions collected and presented in this book aim to shed light on the implications of this trend for the EU constitutional order, the human rights of those affected by these deals, the third countries with which the EU cooperates, and the global refugee protection regime. They demonstrate how these deals raise more issues than they solve; by, for instance, sidestepping established Treaty rules and procedures, violating the human rights of those affected, and overburdening the nascent migration and asylum systems of third country partners. This book, the first volume to appear in the Global Europe Series, will be of great interest to researchers and policy makers working in the field of migration and asylum.
