Excerpt from The Principles of the Administrative Law Governing the Relations of Public Officers It is intended in these lectures to deal with the law governing the execution of law by public officers so far as such a law has a place in our system of law. The attempt will be to discover the principal rules of law that govern in administration: the object of which is to arrive at some theory as to the nature of this administrative law which regulates the rights and duties of officials in their various relations. Administrative law, then, is that body of rules which defines the authority and the responsibility of that department of the government which is charged with the enforcement of the law. At all events, the experiment in these lectures will be to treat these problems of administration as matters of law. The public administration is above all for us, the protection of our rights and the pursuit of the public good. This handbook will be of interest to all those concerned with the proper functioning of public administration: individuals who apply for public services and action and the public officials who process their applications; lawyers, judges and ombudspersons involved in the review of the public administration’s activities; and policy makers and legislators concerned with public administration reform. It sets out and explains the substantive and procedural principles of administrative law concerning relations between individuals and public authorities, with commentary backed up by references to the Council of Europe legal instruments (conventions, recommendations and resolutions) from which each principle is drawn and to the relevant case law of the European Court of Human Rights.

THE DISTINCTION BETWEEN "POLITICS" AND "ADMINISTRATION" According to Goodnow, politics is concerned with policy and other expressions of state will. Administration is concerned with the faithful execution of enacted legislation. He observes that administration has a tendency to overstep this boundary and concedes that politics must therefore monitor administration to keep it in line with the state's will. Reprint of first edition. "From both the legal and historical standpoint the book contains many things that are richly suggestive. There is very little in our legal or political literature so penetrating as for example the exposition of the effects of confinement of the principle of separation of powers to the central government. (...) It is not written for the legal profession directly, but to those lawyers who seek more than a working tool in their profession, a true appraisement of the administrative law, it will appeal. The writing of such a work moreover is a signal public service." --6 Columbia Law Review (1906) 133 While a member of the Columbia faculty, FRANK J. GOODNOW [1859-1939] was the first individual in the United States to hold a professorship in administrative law. He became the first president of the American Political Science Association, which offers an annual award in his name, and was president of Johns Hopkins University from 1915-1929.

This book is exceptional in the sense that it provides an introduction to law in general rather than the law of one specific jurisdiction, and it presents a unique way of looking at legal education. It is crucial for lawyers to be aware of the different ways in which societal problems can be solved and to be able to discuss the advantages and disadvantages of different legal solutions. In this respect, being a lawyer involves being able to reason like a lawyer, even more than having detailed knowledge of particular sets of rules. Introduction to Law reflects this view by focusing on the functions of rules and on ways of arguing the relative qualities of alternative legal solutions. Where ‘positive’ law is discussed, the emphasis is on the legal questions that must be addressed by a field of law and on the different solutions which have been adopted by, for instance, the common law and civil law tradition. The law of specific jurisdictions is discussed to illustrate possible answers to questions such as when the existence of a valid contract is assumed.
