The Right To Political Participation

This book provides a comparative analysis of how judgments from the European Court of Human Rights (ECtHR) and the Inter-American Court of Human Rights (IACtHR) affect political participation and electoral justice at the national level. Looking at specific countries, the work analyses the legal impact the implementation of the ECtHR and the IACtHR judgments has, with a specific focus on cases in which the regional court concerned uses the "democratic argument," that is, an argument related to democracy and political rights. The reasoning is that, although democracy is a much wider concept, judgments concerning violations of political rights and electoral justice provide reliable indicators to assess the status and sustainability of democracy in a State. Moreover, the analysis of the violations of political rights and electoral justice allows an in-depth comparison between the two regional human rights systems. Mindful of the broader scope of the fall-out generated by the non-implementation of judgments, including in socio-economic terms, the book includes a section exploring how judgments issued by the ECtHR and the IACtHR affect voters' participation in the countries under their jurisdiction. To this end, an original dataset including the 47 Member States of the Council of Europe and the 20 countries which recognised the adjudicatory jurisdiction of the IACtHR is built. Multidisciplinary in aim and scope of analysis, the book will be an invaluable resource for researchers, academics, and policy-makers working in the areas of constitutional law, international human rights law, and political economy.

In the last decades, political participation expanded continuously. This expansion includes activities as diverse as voting, tweeting, signing petitions, changing your social media profile, demonstrating, boycotting products, joining flash mobs, attending meetings, throwing seedbombs, and donating money. But if political participation is so diverse, how do we recognize participation when we see it? Despite the growing interest in new forms of citizen engagement in politics, there is virtually no systematic research investigating what these new and emerging forms of engagement look like, how prevalent they are in various societies, and how they fit within the broader structure of well-known participatory acts conceptually and empirically. The rapid spread of internet-based activities especially underlines the urgency to deal with such challenges. In this book, Yannis Theocharis and Jan W. van Deth put forward a systematic and unified approach to explore political participation and offer new conceptual and empirical tools with which to study it. Civil Paths to Peace contains the analyses and findings of the Commonwealth Commission on Respect and Understanding, established in response to the 2005 request of Commonwealth Head of Government for the Commonwealth Secretary-General to 'explore initiatives to promote mutual understanding and respect among all faiths and communities in the Commonwealth.' This report focuses particularly on the issues of terrorism, extremism, conflict and violence, which are much in ascendancy and afflict Commonwealth countries as well as the rest of the world. It argues that cultivating respect and understanding is both important in itself and consequential in reducing violence and terrorism. It further argues that cultivated violence is generated through fomenting disrespect and fostering confrontational misunderstandings. The report looks at the mechanisms through which violence is cultivated through advocacy and recruitment, and the pre-existing inequalities, deprivations and humiliations on which those advocacies draw. These diagnoses also clear the way for methods of countering disaffection and violence. In various chapters the different connections are explored and examined to yield general policy recommendations. Accepting diversity, respecting all human beings, and understanding the richness of perspectives that people have are of great relevance for all Commonwealth countries, and for its 1.8 billion people. They are also importance for the rest of the world. The civil paths to peace are presented here for use both inside the Commonwealth and beyond its boundaries. The Commonwealth has survived and flourished, despite the hostilities associated with past colonial history, through the use of a number of far-sighted guiding principles. The Commission argues that those principles have continuing relevance today for the future of the Commonwealth--and also for the world at large.

The history of democracies has been marked by the struggle to expand voting rights. Many groups, including women, only gained the right to vote in the last century, and continue to be underrepresented in political office. Political Participation and Voting Rights, one of the titles in the Foundations of Democracy series, discusses how a government of the people requires its citizens to provide regular input on policies and decisions through consultations and voting.

This Commentary provides the reader with a review of international standards and practice relating to the political participation of minorities. Political participation has been increasingly recognized as a foundational issue in the debate about minority rights. It is argued that minorities are more likely to feel co-ownership in the state if they have the opportunity to participate freely and effectively in all aspects of its governance, and that sustained and meaningful engagement will guard against the sense of alienation and exclusion among minorities that often emerges in ethnically divided societies. Taking as its starting point the two most important standard-setting documents in the field - the Lund Recommendations on the Effective Participation of National Minorities in Public Life, developed by the Organization for Security and Cooperation in Europe, and the Council of Europe's Thematic Commentary on the Issue of Political Participation of Minorities - the Commentary locates the international legal entitlement to political participation within the wider context of the right to democratic governance. It also considers effective participation in relation to the right to full and effective equality, as well as the legal entrenchment of these provisions and implementation mechanisms. Individual chapters then consider each of the principal mechanisms aimed at enhancing political participation, ranging from procedures covering minority representation in political institutions to consultative mechanisms and autonomy solutions. The Commentary draws on a team of experts, all of whom are recognized authorities in this specialized area of minority issues.

The practices of participation and engagement are characterised by complexities and contradictions. All celebratory examples of uses of social media, e.g. in the Arab spring, the Occupy movement or in recent LGBTQ protests, are deeply rooted in human practices. Because of this connection, every case of mediated participation should be perceived as highly contextual and cannot be attributed to one (social) specific media logic, necessitating detailed empirical studies to investigate the different contexts of political and civic engagement. In this volume, the theoretical chapters discuss analytical frameworks that can enrich our understanding of current contexts and practices of mediated participation. The empirical studies explore the implications of the new digital conditions for the ways in which digitally mediated social interactions, practices and environments shape everyday participation, engagement or protest and their subjective as well societal meaning.
