Trade Measures In Multilateral Environmental Agreements

This report examines various cases to analyze the use of trade measures in environmental agreements and assembles a series of common issues and lessons learned.

Originally published in 1996. The Montreal Protocol on Substances that Deplete the Ozone Layer is one of the most effective multilateral environmental agreements currently in existence. Established to control the production and consumption of CFCs and other ozone-depleting chemicals, the Protocol is an important example of an agreement which places restrictions on international trade in the interests of the global environmental – a feature which may become common in future treaties. This report examines the development, effectiveness and future of the trade provisions of the ozone regime, concluding that they have contributed significantly to its success in attracting signatories and in limiting ozone depletion. Issues considered include the compatibility of the trade provisions and the GATT, trade restrictions and developing countries, and the new problems of non-compliance and illegal trade in CFCs.

In this publication, a number of recognized practitioners and scholars undertake to explore the realities and the conceptual underpinnings of environmental compliance mechanisms.

Im 20. Jahrhundert wurden einige der aufkommenden Umweltvereinbarungen so gestaltet, dass sie starke wirtschaftliche Anreize bieten. Gleichzeitig fanden Umweltverpflichtungen ihren Weg in Handelsabkommen. Daraus ergaben sich Konflikte zwischen handelsbeschrankenden Umweltmassnahmen und GATT / WTO-Normen zum Schutz des freien Marktes. Zudem loste die aufkommende Umweltkrise eine Debatte uber die Einbeziehung von Umweltwerten auf der WTO-Ebene aus. Die Themen waren jahrzehntelang Gegenstand von Diskussionen im GATT / WTO. Unterdessen haben regionale Handelsvereinbarungen eine Plattform fur die Vereinbarung von Umweltverpflichtungen mit dem Freihandel vorbereitet. Diese Vereinbarungen werden als Rechtsinstrumente auf ihre Eignung gepruft, konkurrierende Handels- und Umweltwerte in Einklang zu bringen.
