Founded in 1993, the African Yearbook, now published under the auspices of the African Foundation for International Law, is the only scholarly publication devoted exclusively to the study, development, dissemination and wider appreciation of international law in Africa as a whole. Through the scholarly analysis of international legal issues of particular relevance to the African continent, it also contributes to the acceptance of, and respect for the rule of law in intra-African relations, and for the principles of international law in general. Its uniqueness however goes beyond this, for through its special themes and general articles, it has succeeded over the years to serve as an intellectual forum where the development of international law is viewed as being integral to Africa s own development.Through the study and analysis of emerging legal issues of particular relevance to Africa, such as the creation of viable continental institutions capable of promoting unity and security for the peoples of the continent, the effective protection of human rights, the need for accountability for mass killings and massive violations of the rule of law, the promotion of a rule-based democratic culture, the role of African countries in a globalizing world economy and in international trade relations, the Yearbook strives to be responsive to the intellectual needs of African countries in the area of international law, and to the continuing struggle for creating an environment conducive to the rule of law throughout the continent. The Yearbook also provides ready access to the basic documents of African international organizations by regularly publishing the resolutions and decisions of regional and sub-regional organizations as well as the conventions, protocols and declarations adopted by pan-african agencies.

Climate change, population growth and the increasing demand for water are all capable of leading to disputes over transboundary water systems. Dealing with these challenges will require the enhancing of adaptive capacity, the improving of the quality of water-resources management and a reduction in the risk of conflict between riparian states. Such changes can only be brought about through significant international cooperation. Christina Leb's analysis of the duty to cooperate and the related rights and obligations highlights the interlinkages between this duty and the principles of equitable and reasonable utilisation and the prevention of transboundary harm. In doing so, she considers the law applicable to both international watercourses and transboundary aquifers, and explores the complementarities and interaction between the rules of international water law and the related obligations of climate change and human rights law.

Les principes applicables à des organes communs agissants efficacement pour la coopération relative aux eaux transfrontières, présentés dans cette présente publication, reposent sur des enseignements précieux tirés de l’expérience d’organes communs du monde entier, de Parties à la Convention sur l’eau et d’autres États, ainsi que d’autres parties prenantes. Ces expériences ont été recueillies à l’occasion d’un vaste processus de consultation mené dans le cadre de la Convention sur l’eau. À sa septième session (Budapest, 17-19 novembre 2015), la Réunion des Parties à la Convention sur l’eau a formellement adopté les principes et encouragé les pays à les appliquer. Ces principes ont pour objectif de faciliter la création et les travaux d’organes communs et, en fin de compte, de contribuer à parvenir à un haut niveau de coopération entre États riverains. Ils sont particulièrement pertinents compte tenu de l’ouverture de la Convention sur l’eau à la signature de tous les États Membres de l’ONU et peuvent aider les pays à appliquer l’une des principales obligations découlant de la Convention.

Cette publication présente et analyse les conclusions du premier exercice pilote de rapport dans le cadre de la Convention sur l'eau, réalisé en 2017. Les progrès réalisés dans la mise en œuvre de la Convention sont passés en revue et résumés, ainsi que l'identification des tendances significatives, des succès, des défis et des opportunités concernant la coopération transfrontalière dans le domaine de l'eau. Le mécanisme d'établissement de rapports au titre de la Convention a été formellement adopté (décision VII/2) par la Réunion des Parties à la Convention sur l'eau lors de sa septième session (Budapest, 17-19 novembre 2015).
