This study of the Pearl Harbor attack clarifies the debate in two important ways: first, it definitively exposes who delayed Japan's notice of war to the United States, a serious blunder which stigmatized Japan for launching a premeditated "sneak attack", and second, it examines how the Foreign Ministry has dealt with this blunder from the immediate postwar period to the present. When the Soviet Union and Nazi Germany partitioned Poland in September of 1939, thousands of Jews fled Poland into Lithuania and fled across the USSR to Japan. With the help of Jan Zwartendijk, acting Dutch consul, and Chiune Sugihara, Japan's vice consul in Lithuania, the refugees obtained documents for their perilous escape from Nazi persecution. From Japan, many refugees moved on to Dutch-controlled Curacao or other final destinations. Decades after the war, and one year before his death in 1986, Sugihara was finally honored by Israel with the "Righteous Among the Nations" Award for the help he gave to the Jews in 1940. He also received the Raoul Wallenburg Award posthumously in 1990. However, in Japan little was known about Sugihara's heroic actions for more than five decades. The author, Seishiro Sugihara (no relation to Chiune), reveals a pattern of deception and obfuscation by Japan's foreign ministry to obstruct recognition of Sugihara's philanthropy. The Sugihara episode, the author contends, is only one in a long line of scandalous cover-ups which have plagued the Ministry, including its ill-fated Twenty-One Demands upon Nationalist China in 1915; and more infamously the failure of its Washington Embassy to follow orders and deliver the "declaration of war" on December 7, 1941 which resulted in the Pearl Harbor operation being stigmatized as a "sneak attack." His book is the first to demonstrate that, while Japan's military was abolished during the Occupation, the Foreign Ministry secured its own future at the expense of Japan and the Japanese people, and deliberately and systematically placed Sugihara's act of kindness beyond public scrutiny.

However, the information contained in his memoir was unavailable to most of the world, save those fluent in Japanese, because it had never been published in another language. With the discovery of Kurusu’s own English memoir, his story can finally be told to a wider audience. Clifford and Okura have used both the Japanese and English memoirs and added an introduction and annotations to Kurusu’s story, making The Desperate Diplomat an essential look at an event that remains controversial in the history of both nations. Anyone who takes interest in the history of Pearl Harbor cannot afford to omit this previously unavailable information from their library.

Fair Opportunity and Responsibility lies at the intersection of moral psychology and criminal jurisprudence and analyzes responsibility and its relations to desert, culpability, excuse, blame, and punishment. It links responsibility with the reactive attitudes but makes the justification of the reactive attitudes depend on a prior and independent conception of responsibility. Responsibility and excuse are inversely related; an agent is responsible for misconduct if and only if it is not excused. As a result, we can study responsibility by understanding excuses. We excuse misconduct when an agent's capacities or opportunities are significantly impaired, because these capacities and opportunities are essential if agents are to have a fair opportunity to avoid wrongdoing. This conception of excuse tells us that responsibility itself consists in agents having suitable cognitive and volitional capacities - normative competence - and a fair opportunity to exercise these capacities free from undue interference - situational control. Because our reactive attitudes and practices presuppose the fair opportunity conception of responsibility, this supports a predominantly retributive conception of blame and punishment that treats culpable wrongdoing as the desert basis of blame and punishment. We can then apply the fair opportunity framework to assessing responsibility and excuse in circumstances of structural injustice, situational influences in ordinary circumstances and in wartime, insanity and psychopathy, immaturity, addiction, and crimes of passion. Though fair opportunity has important implications for each issue, treating them together allows us to explore common themes and appreciate the need to take partial responsibility and excuse seriously in our practices of blame and punishment.
