Big Data Analytics And Its Impact On Basin Water Agreements And International Water Law

Big data analytics is transforming the water sector at the national and international levels. Its potential impact on transboundary water resource governance is being assessed, in the context of selected basins in this book.

Technological change is at the core of all major disruptions in human history, and revolutions, wars, and general development are regularly connected to some sort of technological change. However, not all development is beneficial. While technology has fueled great innovations and rapid development, the notion of sustainable development has gained prominence as we now experience serious social, economic, and environmental challenges. This book examines whether technology can be used to fix the very problems caused by technology, as the various chapters examine different aspects related to how technology has brought us where we are today (which some will say is the best place humanity’s been at according to a range of metrics), and whether technology helps or hinders us in our efforts to solve the challenges we currently face. The issues discussed cover the three sustainability dimensions and include topics such as the materiality of AI, technology in education, AI for gender equality, innovation and the digital divide, and how technology relates to power, the political system, and capitalism. The chapters all build on the theoretical backdrop of technological change, sustainable development, and the UN’s Sustainable Development Goals are actively used throughout this book, both to examine how these goals capture or overlook central elements of sustainable development, and also to facilitate and create a common framework of engagement between the chapters. This book provides a novel combination of traditional theories that are explored through different case studies, providing the ground for a better understanding of how and when technology can –and cannot –be the enabler of sustainable development. It is thus an important resource for students of all disciplines, technologists, and those developing and applying new technologies. It is also a valuable resource for politicians and regulators attempting to harness the power of technology for good, while limiting its negative potential. A common perception of global resource scarcity holds that it is inevitably a catalyst for conflict among nations; yet, paradoxically, incidents of such scarcity underlie some of the most important examples of international cooperation. This volume examines the wider potential for the experience of scarcity to promote cooperation in international relations and diplomacy beyond the traditional bounds of the interests of competitive nation states. The interdisciplinary background of the book’s contributors shifts the focus of the analysis beyond narrow theoretical treatments of international relations and resource diplomacy to broader examinations of the practicalities of cooperation in the context of competition and scarcity. Combining the insights of a range of social scientists with those of experts in the natural and bio-sciences—many of whom work as ‘resource practitioners’ outside the context of universities—the book works through the tensions between ‘thinking/theory’ and ‘doing/practice’, which so often plague the process of social change. These encounters with scarcity draw attention away from the myopic focus on market forces and allocation, and encourage us to recognise more fully the social nature of the tensions and opportunities that are associated with our shared dependence on resources that are not readily accessible to all. The book brings together experts on theorising scarcity and those on the scarcity of specific resources. It begins with a theoretical reframing of both the contested concept of scarcity and the underlying dynamics of resource diplomacy. The authors then outline the current tensions around resource scarcity or degradation and examine existing progress towards cooperative international management of resources. These include food and water scarcity, mineral exploration and exploitation of the oceans. Overall, the contributors propose a more hopeful and positive engagement among the world’s nations as they pursue the economic and social benefits derived from natural resources, while maintaining the ecological processes on which they depend.

The Research Handbook on International Water Law surveys the field of the law of shared freshwater resources. In some thirty chapters, it covers subjects ranging from the general principles operative in the field and international groundwater law to the human right to water and whether international water law is prepared to cope with climate disruption. The authors are internationally recognized experts in the field, most with years of experience. The Research Handbook is edited by three scholars and practitioners whose publications and work deal with the law of international watercourses.

The world’s freshwater supplies are increasingly threatened by rapidly increasing demand and the impacts of global climate change, but current approaches to transboundary water management are unsustainable and may threaten future global stability and international security. The absence of law in attempts to address this issue highlights the necessity for further understanding from the legal perspective. This book provides a fresh conceptualisation of water security, developing an operational methodology for identifying the four core elements of water security which must be addressed by international law: availability; access; adaptability; and ambit. The analysis of the legal framework of transboundary freshwater management based on this contemporary understanding of water security reveals the challenges and shortcomings of the current legal regime. In order to address these shortcomings, the present mindset of prevailing rigidity and state-centrism is challenged by examining how international legal instruments could be crafted to advance a more flexible and common approach towards transboundary water interaction. The concept of considering water security as a matter of ‘regional common concern’ is introduced to help international law play a more prominent role in addressing the challenges of global water insecurity. Ways for implementing such an approach are proposed and analysed by looking at international hydropolitics in Himalayan Asia. The book analyses transboundary water interaction as a ‘case study’ for advancing public international law in order to fulfil its responsibility of promoting international peace and security.

"Water is becoming an increasingly scarce resource for most of the world's citizens. The current trends indicate that the overall situation is likely to deteriorate further, at least for the next decade, unless the water profession eschews "business as usual" practices, which can only allow incremental changes to occur." Groundwater is the least understood and least appreciated, yet the most important, natural resource available to mankind. Groundwater represents about 97% of the existing fresh water resources, excluding the resources locked in polar ice. More than one and a half billion people in the urban parts of the world today depend on groundwater. Groundwater supply is more reliable than the seasonal, and sometimes erratic, surface water and provides the main line of defense against drought. Moreover, the quality of groundwater is, by and large, superior to surface water and cheaper to develop. However, when available, data on groundwater is very scanty. As a result, the World Bank is now paying increasing attention to this valuable resource, through both operations and sector work. This publication represents the proceeding of the seminar "Groundwater: Legal and Policy Perspectives" that was organized by the Legal Vice Presidency of the World Bank. It explains some basic technical aspects of groundwater, surveys the regulatory framework for it, and discusses the World Bank experience and international law regarding this precious resource. It is a timely publication and should also assist in a better understanding and appreciation of this valuable source. It will be of interest to Bank staff, borrowing country officials, international agencies and research organizations working on groundwater.
