Across the nineteenth and twentieth centuries, legislators in Bombay passed a series of repetitive laws seeking to control prostitution. During the same time, Bombay's sex industry grew vast in scale. Ashwini Tambe explores why these remarkably similar laws failed to achieve their goal and questions the actual purpose of such lawmaking.

Despite ongoing efforts to maintain ethical standards, highly publicized episodes of corporate misconduct occur with disturbing frequency. Firms produce defective products, release toxic substances into the environment, or permit dangerous conditions to existin their workplaces. The propensity for irresponsible acts is not confined to rogue companies, but crops up in even the most respectable firms. Codes of Conduct is the first comprehensive attempt to understand these problems by applying the principles of modern behavioral science to the study of organizational behavior. Codes of Conduct probes the psychological and social processes through which companies and their managers respond to a wide array of ethical dilemmas, from risk and safety management to the treatment of employees. The contributors employ a wide range of case studies to illustrate the effects of social influence and group persuasion, organizational authority and communication, fragmented responsibility, and the process of rationalization. John Darley investigates how unethical acts are unintentionally assembled within organizations as a result of cascading pressures and social processes. Essays by Roderick Kramer and David Messick and by George Loewenstein focus on irrational decision making among managers. Willem Wagenaar examines how worker safety is endangered by management decisions that focus too narrowly on cost cutting and short time horizons. Essays by Baruch Fischhoff and by Robyn Dawes review the role of the expert in assessing environmental risk. Robert Bies reviews evidence that employees are more willing to provide personal information and to accept affirmative action programs if they are consulted on the intended procedures and goals. Stephanie Goodwin and Susan Fiske discuss how employees can be educated to base office judgments on personal qualities rather than on generalizations of gender, race, and ethnicity. Codes of Conduct makes an important scientific contribution to the understanding of decisionmaking and social processes in business, and offers clear insights into the design of effective policies to improve ethical conduct.

Codes of conduct dienen der Selbstkontrolle und sind Selbstverpflichtungen der Unternehmen, sich gesetzeskonform und in ethischer Hinsicht einwandfrei zu verhalten. Zur Entwicklung, Einfuhrung und Durchsetzung von Codes of Conduct sind Ethics & Compliance Programme notwendig, die den Mitarbeitern die Ziele und Inhalte der Codes vermitteln. Je nach bereichsspezifischer und regionaler Ausrichtung der Unternehmen unter- scheiden sich ihre Codes of Conduct in Inhalt und Gestaltung. In dieser Studie werden die Codes of Conduct von sechs Pharmaunternehmen in Europa, USA und Japan analysiert und verglichen.

Chapters of this issue of New Directions for Higher Education present tenets of codes of conduct for the presidency, academic deans, admissions officers, fund-raising professionals, faculty who teach undergraduate students, and faculty who teach graduate students. The need for such codes of conduct stems from the client-serving role of colleges and universities. Such clients include prospective donors, prospective students and their families, the individual college or university, faculty members, undergraduate and graduate students, and the knowledge base of the various academic disciplines. Because presidents, academic deans, admissions officers, fund-raising professionals, and faculty members experience role ambiguity and substantial autonomy in the performance of their roles, codes of conduct are needed to protect the welfare of the clients served. The authors offer recommendations for policy and practice regarding the proposed codes of conduct. Organizational constraints and possibilities of enacting such codes are also discussed.

Following a decade of firsthand reporting at the Houston Chronicle, investigative reporter Lise Olsen charts McBroom’s assault and the aftermath, when McBroom was thrust into the role of whistleblower to denounce a federal judge. What Olsen discovered by investigating McBroom’s story and other federal judicial misconduct matters nationwide was shocking. With the help of other federal judges, Kent was being protected by a secretive court system that has long tolerated or ignored complaints about corruption, sexism, and sexual misconduct—enabling him to remain in office for years. Other powerful judges accused of judicial misconduct were never investigated and remain in power or retired with full pay, such as US Circuit Judge Alex Kozinski and Kozinski’s mentee, Brett Kavanaugh. McBroom’s ultimate triumph is a rare story of redemption and victory as Judge Kent became the first and only federal judge to be impeached for sexual misconduct. Olsen also weaves in narratives of other brave women across the country who, at great personal risk, have reported federal judges to reveal how sexual harassment and assault occur elsewhere inside the federal court system. The accounts of the women and their allies who are still fighting for reforms are moving, intimate, and inspiring—including whistleblowers and law professors like Leah Litman, Emily Murphy, and novelist Heidi Bond, who emerged to denounce Kozinski in 2017. A larger group of women—and men—banded together to form a group called Law Clerks for Accountability, which is continuing to push for more reforms to the courts’ secretive complaint review system. Code of Silence also reveals the role the press plays in holding systems of power in check. Kent would not have been charged had it not been for Olsen’s reporting and the Houston Chronicle’s commitment to the story.

In Faculty Misconduct in Collegiate Teaching, higher education researchers John Braxton and Alan Bayer address issues of impropriety and misconduct in the teaching role at the postsecondary level. Braxton and Bayer define and examine norms of teaching behavior: what they are, how they come to exist, and how transgressions are detected and addressed. Do faculty members across various collegiate settings, for example, share views about appropriate and inappropriate teaching behaviors, as they share expectations regarding actions related to research? And what mechanisms are utilized to correct inappropriate behavior on the part of college and university teachers? The authors' work is based on survey results obtained from faculty members at research universities, liberal arts colleges, and two-year community, junior, and technical colleges. Braxton and Bayer's focus is on undergraduate teaching in four disciplines: biology, history, mathematics, and psychology. In their analyses, the authors examine how individual, disciplinary, and institutional differences influence professorial behavior. In contrast to the more explicitly understood and enforced rules of conduct in research, the authors find that teaching norms are informally defined and observed. They argue that a formal code of ethics for undergraduate teaching would serve the dual purpose of improving undergraduate education and elevating the status of college teaching.
