Crop Genetic Resources As A Global Commons

Our food and livelihood security depend on the sustained management of the diverse biological resources that make up the Earth's plant genetic resources. This book is about the creation, management and use of the global crop commons, based upon the International Treaty on Plant Genetic Resources for Food and Agriculture.

The joint challenges of population increase, food security and conservation of agrobiodiversity demand a rethink of plant breeding and agricultural research from a different perspective. While more food is undeniably needed, the key question is rather about how to produce it in a way that sustains biological diversity and mitigates climate change. This book shows how social sciences, and more especially law, can contribute towards reconfiguring current legal frameworks in order to achieving a better balance between the necessary requirements of agricultural innovation and the need for protection of agrobiodiversity. On the assumption that the concept of property can be rethought against the background of the 'right to include', so as to endow others with a common 'right to access' genetic resources, several international instruments and contractual arrangements drawn from the plant-breeding field (including the Convention on Biological Diversity, technology exchange clearing houses and open sources licenses) receive special consideration. In addition, the authors explore the tension between ownership and the free circulation and exchange of germplasm and issues such as genetic resources managed by local and indigenous communities, the ITPGRFA and participatory plant-breeding programmes. As a whole, the book demonstrates the relevance of the 'Commons' for plant breeding and agricultural innovation.

There is much current controversy over whether the rights to seeds or plant genetic resources should be owned by the private sector or be common property. This book addresses the legal and policy aspects of the multilateral seed management regime. First, it studies in detail the International Treaty on Plant Genetic Resources for Food and Agriculture (the Treaty) in order to understand and identify its dysfunctions. Second, it proposes solutions - using recent developments of the "theory of the commons" - to improve the collective seed management system of the Treaty, a necessary condition for its member states to reach the overall food security and sustainable agriculture goals. Redesigning the Global Seed Commons provides a significant contribution to the current political and academic debates on agrobiodiversity law and governance, and on food security and food sovereignty, by analyzing key issues under the Treaty that affect the design and implementation of regulatory instruments managing seeds as a commons. It also examines the practical, legal, political and economic problems encountered in the attempt to implement these obligations in contemporary settings. In particular, it considers how to improve the Treaty implementation by proposing ways for Contracting Parties to better reach the Treaty’s objectives taking a holistic view of the human-seed ecosystem. Following the tenth anniversary of the functioning the Treaty’s multilateral system of access and benefit-sharing, which is currently under review by its Contracting Parties, this book is well-timed to examine recent developments in the field and guide the current review process to design a truly Global Seed Commons.

The book reflects the work in progress regarding the analysis of the costs of crop genetic resources conservation that has been conducted at various research insti tutes over the last couple of years, including research conducted at ZEF and asso ciated institutes. In addition, contributions in this publication were presented at a special session during the "Global Dialogue: The Role of the Village in the 2]'1 Century: Crops, Jobs and Livelihood" in Hannover, Germany, at the World Exposition in Au gust 2000. The purpose of the publication is to make a general contribution to the ongoing discussion about the conservation of crop genetic resources as part of the global strategy to secure increasing food production in a sustainable way. Specifically, it discusses the costs of the worldwide efforts to conserve crop genetic resources on the basis of theoretical and applied studies. It aims to serve decision-makers at dif ferent levels with information on the costs involved in the conservation of genetic resources and hence to increase the awareness of the importance of improving the cost effectiveness of different conservation methods in order to optimize the sus tainability of conservation. The quoted Leipzig Declaration, which was adopted at the Fourth International Technical Conference on Plant Genetic Resources in Leipzig in June 1996, dem onstrates the close linkage of the contributions to the ongoing discussion about the implementation of the Global Plan of Actionfor the Conservation and Sustainable Utili zation of Plant Genetic Resources for Food and Agriculture.

The Convention on Biological Diversity (CBD) strives for the sustainable and equitable utilization of genetic resources, with the ultimate goal of conserving biodiversity. The CBD and the Nagoya Protocol which has since been elaborated suggest a bilateral model for access to genetic resources and the sharing of benefits from their utilization. There is concern that the bilateral exchange "genetic resource for benefit sharing" could have disappointing results because providers are left out of the process of research and development, benefits are difficult to be traced to sources, and providers owning the same resource may complain of being excluded from benefit sharing. Thus, the CBD objective of full utilization and equitability may become flawed. Common Pools of Genetic Resources: Equity and Innovation in International Biodiversity Law suggests common pools as a complementary approach to bilateralism. This is one of the first books to reply to a number of complex legal questions related to the interpretation and implementation of the Nagoya Protocol. Taking an inductive approach, it describes existing pools and analyzes how they are organized and how they perform in terms of joint R&D and benefit sharing. It presents case studies of the most characteristic types of common pools, provides suggestions for further developing existing pools to cope with the requirements of the CBD and NP and, at the same time uses the clauses these conventions contain to open up for commons approaches. Written by a team of expert academics and practitioners in the field, this innovative book makes a timely and valuable contribution to academic and policy debates in international environmental law, international biodiversity law, intellectual property law, climate law and the law of indigenous populations.
