Environmental protection is fundamental for the establishment of sustainable peace. Applying traditional legal approaches to protection raises particular challenges during the transition from conflict to peace. In the jus post bellum context, protection of the environment and natural resources needs to be considered in tandem with a broad range of simultaneously applicable normative frameworks, such as human rights, transitional justice, arms control/disarmament, UN law and practice, development, and domestic law. While certain multilateral environment agreements, such as the Convention Concerning the Protection of the World Cultural and Natural Heritage protect the environment; international humanitarian law and international criminal law continue to treat environmental protection largely from an anthropocentric perspective. This book is the first targeted work in the legal literature that investigates environmental challenges in the aftermath of conflict. Addressing these challenges, it brings together academics, policy-makers, and practitioners from different disciplines to clarify policies and practices of environmental protection and key normative frameworks. It draws on experiences and practices in post-conflict settings to specify substantive principles and techniques to remedy and prevent harm.

The decline of the East-West conflict has opened up the arena for increased attention to other lines of conflict, in Europe and at the global level. Environmental disruption, not a new phenomenon by any means, is a chief beneficiary of the shift in priorities in the public debate. The Scientific and Environmental Affairs Divi sion of NATO has moved with the times and has defined environmental security as one of its priority areas for cooperation with Central and Eastern Europe and countries of the former Soviet Union. This book is the main output of an Advanced Research Workshop (ARW), held in Bolkesjl/l, Norway, 12-16 June 1996. I would like to acknowledge the personal support of L. Veiga da Cunha, Director of the Priority Area on Environmental Security. Research on these issues is now very much a collaborative effort across former lines of division in Europe. Today’s changing security landscape requires a radical shift in the way the international community engages in conflict management. This report by the United nations Environment Programme aims to review the latest knowledge and field experience on the linkages between environment, conflict and peacebuilding, and to discuss the ways in which these issues can be addressed and integrated in a more coherent and systematic way by the UN, Member States and other stakeholders involved in peacebuilding interventions and conflict prevention.

This book argues that a set of persuasive narratives about the links between natural resource, armed conflict and peacebuilding have strongly influenced the natural resource interventions pursued by international peacebuilders. The author shows how international peacebuilders active in Liberia and Sierra Leone pursued a collective strategy to transform "conflict resources" into "peace resources" vis-à-vis a policy agenda that promoted "securitization" and "marketization" of natural resources. However, the exclusive focus on securitization and marketization have been counterproductive for peacebuilding since these interventions render invisible issues connected to land ownership, environmental protection and sustainable livelihoods and mirror pre-war governing arrangements in which corruption, exclusion and exploitation took root. Natural resource governance and peacebuilding must go beyond narrow debates about securitization and marketization, and instead be a catalyst for trust-building and cooperation that has a local focus, and pursues an inclusive agenda that not only serves the cause of peace, but the cause of people. The chapters in this volume have their origins in papers presented at a Workshop held at Lund University in Sweden. The Workshop gathered together experts from Europe, the United States and Australia, including leading academics as well as representatives from the ICRC, the Swedish, Norwegian and Danish Red Cross Societies and the Swedish and Norwegian governments, to examine the relevance and adequacy of the existing regime for environmental protection during armed conflict as well as the ability of other international legal mechanisms to contribute to the amelioration of damage to the environment arising as a result of or in relation to armed conflict. The book, like the Workshop, takes as its starting point the existing IHL regime for the protection of the environment during armed conflict and goes on to explore the application of other legal regimes that may be relevant to protection of the environment both during armed conflict and, as in the broader context envisaged by the ILC, in relation to armed conflict. As this thought-provoking volume demonstrates, a vast range of issues, actors and legal regimes must now be considered and some pro-active and imaginative research and thinking brought to bear in any consideration of this ever-important topic.
