International Law Concerning Child Civilians In Armed Conflict

Each year, many thousands of child civilians are killed, injured, or otherwise physically and psychologically harmed as a result of armed conflicts. There is a considerable body of international law which aims to minimise the harm inflicted on these children, and yet it is little known, orobserved. This book is the first major international legal text to focus exclusively on child civilians. It addresses three main questions: (1) what are the precise rules incorporated in the pertinent body of law, and what are its implementation mechanisms? (2) how effective is it (with reference torecent conflicts involving Iraq) in helping to achieve some protection for child civilians? and (3) can it be rendered more effective? The book concludes by proposing a number of strategies to strengthen the impact of the applicable law. As the first detailed analysis of the surprisingly large bodyof law relevant to the treatment of child civilians, this book is an important contribution to a topical and highly charged human rights issue.

During recent armed conflicts - such as those in Iraq, the former Yugoslavia, and Rwanda - public attention was repeatedly caught by images of children, both as civilians and as soldiers. Those conflicts, like so many others, were vivid reminders that where there is armed conflict there are also, almost always, children. Soldiers and officers fulfil many roles in relation to such children - sometimes as combatants, sometimes as humanitarian workers, sometimes as protectors, and/or sometimes as enemies and abusers. This book aims to address three main questions: what are the obligations of officers of national armed forces in relation to children, either civilians or combatants, whom they or those under their command may encounter while participating in situations of armed conflict? How realistic and achievable are these obligations? How can compliance with them be encouraged, monitored, and/or enforced? The book examines these questions in the context of military training. In doing so, it has another inextricably linked aim: to see if there are ways in which the training of officers can improve the protection of children in armed conflict situations, in accordance with international law and policy. It is intended for use particularly by those involved in training of national armed forces, including officers themselves, and members of governments, non-governmental organisations (NGOs) and inter-governmental organisations. It is hoped that it will also be of interest to lawyers, academics and others concerned with 'child rights' and related law and policy. It contains examples of actual training materials that can be modified for use in different countries and contexts.

The purpose of this book is to help researchers and professionals understand the possibilities for protecting children in violent political conflicts. This is the first book to be published on this important, complex and painful topic. Most other publications have concentrated on the effects of political violence on children and adults, but have little or nothing to say on prevention from the point of view of the social sciences. This book represents the beginnings of a new field of inquiry and policy. The book includes: research on the effects of exposure to political violence on children; reports by police and military experts of their experiences in protecting the public and children while keeping order; observations from people in human rights and childrens rights organizations on issues of attempting to report to and observe both sides in a conflict; and work by legal researchers on international law relating to the protection of children in political conflicts.

In armed conflicts around the world, children are being killed, raped, abducted and recruited to fight at a shocking scale. In light of this continuing general failure to protect children in conflict, it is questionable whether existing international law norms and institutions provide sufficient protection and accountability. Consideration needs to be given to whether international law can do more – practically and effectively – when moral lines are crossed. That is the purpose of this book. It reviews the position of children in armed conflict by reference to the 'six grave violations' as identified by the UN Security Council. It analyses the protection offered by international humanitarian law, international criminal law and international human rights law, and also assesses the related adjudicative accountability mechanisms. The analysis concludes with a number of recommendations and proposals for reform, with a view to enhancing accountability and deterring future violations. The book has been written by a team of lawyers, headed by Shaheed Fatima QC, and has drawn on the input of an expert advisory panel comprising leading academics, policy-makers and activists. It has been written as part of the Inquiry on Protecting Children in Conflict. The Inquiry has been sponsored by Save the Children and Theirworld and chaired by former UK Prime Minister, Gordon Brown.

This book commences with an analysis of the current state of child soldiering internationally. Thereafter the proscriptive content of contemporary norms on the prohibition of the use and recruitment of child soldiers is evaluated, so as to determine whether these norms are capable of better enforcement. An 'issues-based' approach is adopted, in terms of which no specific regime of law, such as international humanitarian law (IHL), is deemed dominant. Instead, universal and regional human rights law, international criminal law and IHL are assessed cumulatively, so as to create a mutually reinforcing web of protection. Ultimately, it is argued that the effective implementation of child soldier prohibitive norms does not require major changes to any entity or functionary engaged in such prevention; rather, it requires the constant reassessment and refinement of all such entities and functionaries, and here, some changes are suggested. International judicial, quasi-judicial and non-judicial entities and functionaries most relevant to child soldier prevention are critically assessed. Ultimately the conclusions reached are assessed in light of a case study on the use and recruitment of child soldiers in the Democratic Republic of the Congo.

Child soldiers are generally perceived as faultless, passive victims. This ignores that the roles of child soldiers vary, from innocent abductee to wilful perpetrator. This book argues that child soldiers should be judged on their actions and that treating them like a homogenous group prevents them from taking responsibility for their acts.

This book examines selected legal complexities of the notion of torture and the issue of the proper foundation for legally characterizing certain acts as torture, especially when children are the targeted victims of torture. ICC case law is used to highlight the International Criminal Court’s reluctance in practice to prosecute as a separable offence the crime of torture as set out in one or more of the relevant provisions of the Rome Statute where children are the particularized targets as part of a common plan during armed conflict. Also addressed is the failure of the ICC to consider that the young age of the victims of torture (i.e. children) should be an aggravating factor taken into account in determining the ICC sentence for those convicted of the torture of civilians, including children, in the context of armed conflict as part of a common plan. The six UN-designated grave crimes against children (including child soldiering for State or non-State forces perpetrating mass atrocities, and sexual violence perpetrated on a systematic and widespread basis against children including child soldiers), it is argued, are also instances of the torture of children as part of a common plan such that separate charges of torture are legally supportable (along with the other charges relating to additional Rome Statute offences involved in such circumstances). Useful legal perspectives on the issue of the torture of children in its various manifestations gleaned from the case law of other international judicial forums such as the Inter-American Court of Human Rights and the ICTY are also examined.
