Protecting Prisoners

In the past 30 years, the population of prisoners in the United States has expanded almost 5-fold, correctional facilities are increasingly overcrowded, and more of the country's disadvantaged populations—racial minorities, women, people with mental illness, and people with communicable diseases such as HIV/AIDS, hepatitis C, and tuberculosis—are under correctional supervision. Because prisoners face restrictions on liberty and autonomy, have limited privacy, and often receive inadequate health care, they require specific protections when involved in research, particularly in today's correctional settings. Given these issues, the Department of Health and Human Services' Office for Human Research Protections commissioned the Institute of Medicine to review the ethical considerations regarding research involving prisoners. The resulting analysis contained in this book, Ethical Considerations for Research Involving Prisoners, emphasizes five broad actions to provide prisoners involved in research with critically important protections: • expand the definition of "prisoner"; • ensure universally and consistently applied standards of protection; • shift from a category-based to a risk-benefit approach to research review; • update the ethical framework to include collaborative responsibility; and • enhance systematic oversight of research involving prisoners.

Disruptive Prisoners reconstitutes the history of Canada’s federal prison system in the mid-twentieth century through a process of collective biography – one involving prisoners, administrators, prison reformers, and politicians. This social history relies on extensive archival research and access to government documents, but more importantly, uses the penal press materials created by prisoners themselves and an interview with one of the founding penal press editors to provide a unique and unprecedented analysis. Disruptive Prisoners is grounded in the lived experiences of men who were incarcerated in federal penitentiaries in Canada and argues that they were not merely passive recipients of intervention. Evidence indicates that prisoners were active agents of change who advocated for and resisted the initiatives that were part of Canada’s "New Deal in Corrections." While prisoners are silent in other criminological and historical texts, here they are central figures: the juxtaposition of their voices with the official administrative, parliamentary, and government records challenges the dominant tropes of progress and provides a more nuanced and complicated reframing of the post-Archambault Commission era. The use of an alternative evidential base, the commitment of the authors to integrating subaltern perspectives, and the first-hand accounts by prisoners of their experiences of incarceration makes this book a highly readable and engaging glimpse behind the bars of Canada’s federal prisons.

PArt I: The CPT

This handbook discusses the importance of effective prisoner file management, illustrating the consequences of poor or non-existent management. It will be of particular relevance to prison systems that do not have electronic systems for managing files. It outlines the key international human rights standards that apply to prisoner and detainee file management. It also summarizes and illustrates the key requirements of prison systems in relation to prisoner and detainee file management in order to meet international human rights standards and how these might be met.

In the last decade there has been growing international concern about the increasing numbers of women in prison, the effects that imprisonment has on their children, the realisation that gaoled women have different criminal profiles and rehabilitative needs to male prisoners, and the seeming intractability of the associated problems. In response there has been an overarching policy concern in many countries to fashion and co-ordinate gender-specific policies towards female offenders which aim both to slow down the rate of their offending and/or imprisonment, and also to engender flexible programmes which will reduce the time spent in custody and/or away from their young children. The major objective of this book is to describe and analyse contemporary opportunities for, and barriers to, both the reduction of female prison populations and the reduction of the pain of those women who continue to be imprisoned. It assesses the most important recent attempts to reduce both women's imprisonment and the damage it does, identifying and analyzing cross-jurisdiction and gender-specific lessons to be learned, and the unexpected consequences of some of the reform strategies. This book brings together leading scholars and practitioners in the field, providing a critique of the reform initiatives which have taken place, and a much-needed theorization of cross-national policy in this area. It will be essential reading for all with an interest in prisons and prison reform.

This text details critical information on all aspects of prison litigation, including information on trial and appeal, conditions of isolated confinement, access to the courts, parole, right to medical aid and liabilities of prison officials. Highlighted topics include application of the Americans with Disabilities Act to prisons, protection given to HIV-positive inmates, and actions of the Supreme Court and Congress to stem the flow of prison litigation. Part II contains Judicial Decisions Relating to Part I.

Built around the experiences of older prisoners, Punished for Aging looks at the challenges individuals face in Canadian penitentiaries and their struggles for justice. Through firsthand accounts and quantitative data drawn from extensive interviews, this book brings forward the experiences of federally incarcerated people living their "golden years" behind bars. These experiences show the limited ability of the system to respond to heightened needs, while also raising questions about how international and national laws and policies are applied, and why they fail to ensure the safety and well-being of incarcerated individuals. In so doing, Adelina Iftene explores the shortcomings of institutional processes, prison-monitoring mechanisms, and legal remedies available in courts and tribunals, which leave prisoners vulnerable to rights abuses. Some of the problems addressed in this book are not new; however, the demographic shift and the increase in people dying in prisons after long, inadequately addressed illnesses, with few release options, adds a renewed sense of urgency to reform. Working from the interview data, contextualized by participants’ lived experiences, and building on previous work, Iftene seeks solutions for such reform, which would constitute a significant step forward not only in protecting older prisoners, but in consolidating the status of incarcerated individuals as holders of substantive rights.

Over the past four decades, the rate of incarceration in the United States has skyrocketed to unprecedented heights, both historically and in comparison to that of other developed nations. At far higher rates than the general population, those in or entering U.S. jails and prisons are prone to many health problems. This is a problem not just for them, but also for the communities from which they come and to which, in nearly all cases, they will return. Health and Incarceration is the summary of a workshop jointly sponsored by the National Academy of Sciences(NAS) Committee on Law and Justice and the Institute of Medicine(IOM) Board on Health and Select Populations in December 2012. Academics, practitioners, state officials, and nongovernmental organization representatives from the fields of healthcare, prisoner advocacy, and corrections reviewed what is known about these health issues and what appear to be the best opportunities to improve healthcare for those who are now or will be incarcerated. The workshop was designed as a roundtable with brief presentations from 16 experts and time for group discussion. Health and Incarceration reviews what is known about the health of incarcerated individuals, the healthcare they receive, and effects of incarceration on public health. This report identifies opportunities to improve healthcare for these populations and provides a platform for visions of how the world of incarceration health can be a better place.
