Since the Second World War, constitutional justice has spread through much of the democratic world. Often it has followed in the wake of national calamity and historical evil - whether fascism or communism, colonialism or apartheid. Unsurprisingly, the memory of such evils plays a prominent role in constitutional adjudication. This book explores the relationship between constitutional interpretation and the memory of historical evil. Specifically, it examines how the constitutional courts of the United States, Germany, and South Africa have grappled, respectively, with the legacies of slavery, Nazism, and apartheid. Most courts invoke historical evil through either the parenthetical or the redemptive mode of constitutional memory. The parenthetical framework views the evil era as exceptional - a baleful aberration from an otherwise noble and worthy constitutional tradition. Parenthetical jurisprudence reaches beyond the evil era toward stable and enduring values. It sees the constitutional response to evil as restorative rather than revolutionary - a return to and reaffirmation of older traditions. The redemptive mode, by contrast, is more aggressive. Its aim is not to resume a venerable tradition but to reverse recent ills. Its animating spirit is not restoration, but antithesis. Its aim is not continuity with deeper pasts, but a redemptive future stemming from a stark, complete, and vivid rupture. This book demonstrates how, across the three jurisdictions, the parenthetical mode has often accompanied formalist and originalist approaches to constitutional interpretation, whereas the redemptive mode has accompanied realist and purposive approaches. It also shows how, within the three jurisdictions, the parenthetical mode of memory has consistently predominated in American constitutional jurisprudence; the redemptive mode in South African jurisprudence; and a hybrid, parenthetical-redemptive mode in German constitutional jurisprudence. The real-world consequences of these trends have been stark and dramatic. Memory matters, especially in constitutional interpretation.

How do memories circulate transnationally and to what effect? How to understand the enduring role of national memories and their simultaneous reconfiguration under globalization? Challenging the methodological nationalism that has until recently dominated the study of memory and heritage, this book charts the rich production of memory across and beyond national borders. Arguing for the fruitfulness of a transnational as distinct from a global approach, it places the issues of circulation, articulation and the scales of remembrance at the centre of its inquiry. In the process, it sheds new light on the ways in which mediation, post-coloniality, migration and regional integration affect both the way we remember and the role of memory in contemporary societies. In this interdisciplinary collection, humanities and social science scholars examine a rich sample of cases from the nineteenth century on, stretching across the globe from Vietnam to Europe and the Middle East, to the USA and the Pacific, and involving a wide range of cultural practices from quilting to films, from photography to heritage sites and monuments. In the process, the volume develops a new theoretical framework while proposing new methodological tools and resources for studying collective remembrance beyond the nation-state.

This Compendium is a comprehensive reference manual containing an extensive selection of instruments developed to measure signs and symptoms commonly encountered in neurological conditions, both progressive and non-progressive. It provides a repository of established instruments, as well as newly-developed scales, and covers all aspects of the functional consequences of acquired brain impairment. In particular, the text provides a detailed review of approximately 150 specialist instruments for the assessment of people with neurological conditions such as dementia, multiple sclerosis, stroke and traumatic brain injury. Part A presents scales examining body functions, including consciousness and orientation; general and specific cognitive functions; regulation of behaviour, thought, and emotion; and motor-sensory functions. Part B reviews scales of daily living activities and community participation. Part C focuses on contextual factors, specifically environmental issues, and Part D contains multidimensional and quality of life instruments. Each instrument is described in a stand-alone report using a uniform format. A brief history of the instrument's development is provided, along with a description of item content and administration/scoring procedures. Psychometric properties are reviewed and a critical commentary is provided. Key references are cited and in most cases the actual scale is included, giving the reader easy access to the instrument. The structure of the book directly maps onto the taxonomy of the influential International Classification of Functioning, Disability and Health (World Health Organization, 2001), enabling linkage of clinical concepts across health conditions. The Compendium will be a valuable reference for clinicians, researchers, educators, and graduate students, and a practical resource for those involved in the assessment of people with brain impairment. The book is accompanied by a password protected website. For a one-off payment, purchasers of the book can gain online access to the majority of the tests, scales and questionnaires featured in the book as downloadable PDFs. For many years, the need to develop valid tools to evaluate signs and symptoms of Parkinson Disease (PD) has been present. However the understanding of all intricacies of rating scales development was not widely available and the first attempts were relatively crude. In 2002, the Movement Disorders Society created a task force to systemize the measurement of Parkinson's Disease. Since then, the Task Force has produced and published several critiques to the available rating scales addressing both motor and non-motor domains of Parkinson Disease. Additionally the task force initiated a project to develop a new version of the UPDRS, the MDS-UPDRS. But none of this was made available in one convenient source. Until now. Rating Scales in Parkinson's Disease: Clinical Practice and Research is written for researchers from the medical and social sciences, and for health professionals wishing to evaluate the progress of their patients suffering from Parkinson's Disease. The book is both exhaustive in the description of the scales and informative on the advantages and limitations of each scale. As such, the text clearly guides readers on how to choose and use the instruments available. Extensive cross-referenced tables and charts closely integrate the parts of the book to facilitate readers in moving from one symptom domain to another.
