"This report reviews the availability in the Australian market of insurance cover for the personal liability of directors and officers of corporations, commonly referred to as D&O insurance. The review was undertaken in the context of a broader and continuing inquiry by the Advisory Committee in response to a reference from the former Parliamentary Secretary to the Treasurer, Senator the Hon Ian Campbell, into aspects of directors' duties and personal liability. Senator Campbell asked the Advisory Committee to examine amongst other questions the impact of directors' liability on the availability of professional indemnity insurance and the consequences of rising insurance premiums. The availability and scope of insurance cover are relevant to any analysis and understanidng of risks and liabilities to which directors and other officers of companies are exposed." -- p. 1.
